Karma Terms of Service

1. Introduction

Karma provides a self-custody wallet solution that allows you to control your digital assets and seamlessly move between crypto and fiat currencies. You are solely responsible for your wallet security and actions taken through our platform. We provide access to:

• Self-custody cryptocurrency wallets (Phantom wallet integration)
• Crypto-to-fiat off-ramp services via Bridge.xyz
• Debit cards via Rain Cards
• Virtual bank accounts (USD, EUR routing numbers and IBANs)
• Real-time foreign exchange conversions
• Token swap features through Jupiter

Karma never stores or accesses your funds or private keys. Your wallet remains in your control at all times.

2. Eligibility & Consent

By using our services, you represent that:

• You have the legal authority to accept these Terms
• You are at least 18 years of age
• You are not located in a jurisdiction where our services are prohibited
• You are not subject to sanctions by any governmental authority
• You agree to be bound by these Terms and our Privacy Policy

If you do not agree, you may not use the services.

3. Karma Cards

Karma Cards are Visa debit cards issued by our banking partner and may have costs associated with them depending on the card type (Virtual or Physical).

All card purchases are final and non-refundable. We may change features or pricing with notice. You are responsible for checking our app or website for updates.

By using Karma Cards, you agree to:

• These Terms of Service
• The Card Terms provided during onboarding
• The card issuer's policies

Card services are subject to Know Your Customer (KYC) and Anti-Money Laundering (AML) compliance requirements.

4. Account Creation & Responsibilities

Some features require you to create an account. You must:

• Provide truthful and accurate information
• Keep your credentials and wallet access secure
• Maintain control of your email and authentication methods
• Notify us immediately of any security breach
• Complete KYC verification when required

We reserve the right to suspend or terminate accounts at our discretion, especially for violations of these Terms or applicable law.

5. Self-Custody Disclaimer

Karma is a non-custodial platform. You control your wallet and private keys. We are not liable for:

• Loss of access to your wallet or private keys
• Unauthorized transactions from your wallet
• Blockchain network issues or failures
• Errors in smart contract interactions
• Failed transactions due to insufficient gas or network congestion
• Loss of funds due to user error or negligence

You assume full risk and responsibility for your assets. Always ensure you have backed up your wallet recovery phrase and stored it securely.

6. Transaction Fees

Karma charges fees for certain services as outlined on our Fees Page. These may include:

• Off-ramp transaction fees (typically 0.25%)
• Foreign exchange fees
• Card transaction fees
• Blockchain network gas fees (paid to blockchain validators, not Karma)

Fees are subject to change with notice. KARMA token holders may be eligible for fee rebates as described in our documentation.

7. Acceptable Use

You agree not to:

• Violate any law, regulation, or sanction
• Infringe on intellectual property or proprietary rights
• Use our services for money laundering or terrorist financing
• Engage in fraudulent or deceptive practices
• Spread malware, spam, or malicious code
• Interfere with the site, services, or other users
• Reverse engineer, scrape, or extract data from our platform
• Create fake, automated, or bot accounts
• Use the platform for prohibited activities (see our Prohibited Activities list)

Violations may result in immediate account suspension or termination and reporting to authorities where required by law.

8. User Content & License

If you submit content to our platform (feedback, messages, etc.), you grant us a license to use, display, and distribute it to operate the service. You retain ownership of your content.

You must not upload illegal, offensive, defamatory, or infringing material.

9. Third-Party Services

We integrate with third-party service providers. Their services are governed by their own terms and policies:

• Bridge.xyz - Banking infrastructure and off-ramp services
• Rain Cards - Card issuance and management
• Jupiter - Token swap aggregation
• Phantom Wallet - Wallet connection interface
• Sumsub - KYC/AML verification

We are not liable for third-party failures, service interruptions, policy changes, or data handling practices. Your use of third-party services is subject to their respective terms.

10. Disclaimers

The services are provided "as is" without warranties of any kind. We do not guarantee:

• Continuous, uninterrupted access to services
• Error-free or bug-free experience
• Profit or performance of any transaction or investment
• Availability of any specific feature or service
• Accuracy of exchange rates or price data
• Success of any blockchain transaction

Cryptocurrency and DeFi involve significant risk. You may lose some or all of your funds. Past performance does not guarantee future results.

Some jurisdictions may not allow disclaimer of implied warranties. In such cases, our disclaimers are limited to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, Karma Fintech LTD will not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of data, assets, profits, or revenue
• Service outages, delays, or interruptions
• User errors or negligence
• Blockchain network failures or congestion
• Third-party service failures
• Regulatory changes or legal actions

Our total liability to you is capped at £100 GBP or the amount of fees you paid to us in the 12 months preceding the claim, whichever is greater.

12. Dispute Resolution

Governing Law: These Terms are governed by the laws of England and Wales.

Informal Resolution: Before initiating any legal proceedings, you agree to contact us at team@karmapay.xyz to attempt to resolve the dispute informally.

Jurisdiction: Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Intellectual Property

All content, trademarks, logos, and intellectual property on the Karma platform are owned by Karma Fintech LTD or our licensors. You may not use, copy, modify, or distribute our intellectual property without permission.

If you believe content on our platform infringes your copyright, contact us at team@karmapay.xyz with proof and details of the infringement.

14. Termination

We may terminate or restrict your access to the platform at our discretion, especially for:

• Violating these Terms
• Engaging in prohibited activities
• Fraudulent or illegal behavior
• Regulatory requirements
• Risk management purposes

Upon termination, your right to use the services ceases immediately. You may still access your self-custody wallet through other wallet interfaces, as Karma does not control your private keys.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date above. We may also notify you via email.

Continued use of the services after changes become effective means you accept the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
